Terms of Purchase — Emotag Founding Tester Programme

These Terms of Purchase apply to orders for the Emotag Founding Tester Kit placed through emotag.se. Please read them before purchasing.

Nothing in these Terms limits any mandatory rights you have under Swedish law or the consumer law applicable in your country of residence.

Our current contact details are also published at emotag.se/about. If our address changes while your order remains open, we will update the website and notify you where reasonably necessary. A change of address does not reduce your rights under these Terms.

In these Terms, “Emotag”, “we”, “us” and “our” refer to the legal company identified above. “You” means the consumer placing the order.

2. The Founding Tester Kit

The Founding Tester Kit contains the materials required to complete three tests, together with instructions for use.

Emotag detects changes in stress-related signals in a dog’s saliva and displays the result through a visible colour change. It provides an additional signal that can be considered alongside the dog’s behaviour, recent experiences and physical health.

Emotag does not identify the cause of a change, provide a medical diagnosis or replace veterinary care or professional behavioural advice.

3. Who may order

You must be at least 18 years old and legally able to enter into a contract. You must provide accurate contact and delivery information.

You may order from outside the EU. The price is the same, but standard delivery is included only within the EU; section 4 explains how delivery outside the EU is charged.

4. Price and payment

The price of the Founding Tester Kit is €10 as a one-time payment, and it is the same wherever you order from. Standard delivery is included within the EU. Emotag is not currently registered for VAT and does not charge VAT on this purchase. If our tax status changes for future orders, the total price and any applicable tax will be shown before payment is confirmed.

For a delivery address within the EU, no additional charge will be added after you place your order.

For a delivery address outside the EU, shipping is charged separately and is not included in the €10. We will contact you by email with the shipping amount before dispatch. That amount is payable only if you accept it: if you do not, or if you do not reply, we will cancel the order and refund your €10 in full, and nothing is dispatched. Any import duty, customs charge or local tax raised by the destination country is payable by you and is outside our control.

Payments are processed securely by Stripe. Emotag does not receive or store your full payment-card details.

Your order is accepted when Stripe confirms successful payment and we send or display an order confirmation. If we cannot accept your order, we will refund the amount paid.

5. Founding 100 availability

The Founding Tester offer is limited to the first 100 successfully completed and eligible purchases. Adding an item to checkout does not reserve a place. We may close the offer when the limit is reached.

Each person may purchase one Founding Tester Kit unless we agree otherwise. We may cancel duplicate, fraudulent or clearly abusive orders and issue a refund.

6. Delivery schedule

We expect to dispatch kits between December 2026 and May 2027. Dispatch may occur at any point within this period.

If we expect a material delay, we will contact you using the email address provided at checkout. If we cannot dispatch your kit by 31 May 2027, we will issue a full refund to the original payment method unless you expressly agree to a revised delivery date.

You may cancel your order for a full refund at any time before dispatch by emailing hello.emotag@outlook.com or using the online withdrawal function available through the website footer.

We are not responsible for delays caused by an incorrect address, failure to collect a shipment, customs procedures outside the EU or events beyond our reasonable control. This does not affect your right to cancel when delivery is not made within the agreed time or any other mandatory consumer right.

7. Delivery

Standard delivery is included for the EU countries available at checkout. Risk of loss passes to you when you, or a person designated by you other than the carrier, physically receives the kit.

Please inspect the package on arrival and contact us promptly if it is missing, damaged or incomplete. We may ask for reasonable photographs or other information needed to investigate the issue.

8. Right of withdrawal

If you are an EU or EEA consumer, you generally have the right to withdraw from an online purchase without giving a reason within 14 days after you, or a person designated by you, receives the goods.

To exercise this right, use the Withdraw from a purchase function available through the website footer, or send a clear statement to hello.emotag@outlook.com containing your name, order number, address and a statement that you wish to withdraw. You may use the model withdrawal form at the end of these Terms, but this is not mandatory.

You must return the kit within 14 days after informing us of your withdrawal. Before returning it, contact hello.emotag@outlook.com so that we can provide the current return address and reasonable return instructions. Requesting return instructions does not limit or delay your right to withdraw. Unless the goods are faulty, incorrect or we agree otherwise, you are responsible for the direct cost of returning them. We will refund the price paid and the cost of our least expensive standard outbound delivery option within 14 days after receiving your withdrawal notice. We may withhold the refund until we have received the returned goods or you have provided evidence that they have been sent back.

You may inspect the kit only as you would in a physical shop. We may deduct an amount from your refund if the goods have lost value because they were handled beyond what was necessary to establish their nature, characteristics and functioning.

Opening the shipping parcel or outer delivery packaging does not affect your right of withdrawal. However, the Emotag kit contains saliva swabs, test patches and sample-collection materials intended for single use. If the kit is supplied with a clearly marked protective hygiene seal, the right of withdrawal does not apply once that hygiene seal has been broken, where permitted by applicable law, because the contents are not suitable for return for health-protection and hygiene reasons.

This restriction does not affect your rights if the kit is faulty, unsafe, damaged, incomplete or not as described.

9. Faulty, unsafe or incorrect goods

The kit must conform to the contract and the description provided at purchase. Your statutory rights concerning faulty, unsafe, damaged or incorrect goods remain fully applicable.

If there is a problem, contact hello.emotag@outlook.com with your order number and a description of the issue. Depending on the circumstances and applicable law, you may be entitled to repair, replacement, a price reduction or a refund at no additional cost.

10. Safe and appropriate use

Use the kit only as described in the supplied instructions. Keep all components away from children and animals except during supervised saliva collection. Do not allow a dog to chew, swallow or play with any component.

Do not force sampling, and stop if your dog becomes distressed. Emotag does not replace veterinary care. Contact a veterinarian or another appropriate professional if you are concerned about your dog’s health or behaviour.

The kit is intended for personal, at-home use. Follow the instructions supplied with the kit.

11. Tester feedback

As part of the programme, we ask you to complete one short feedback survey after using the kit. Feedback may cover sampling, instructions, usability and your overall experience.

You retain ownership of original material you submit. You grant us a non-exclusive, worldwide, royalty-free right to use non-identifying feedback internally for research, product improvement, quality work and regulatory preparation.

We will not publish your name, photograph, testimonial or identifiable story for marketing without separate permission.

12. Founding benefit

Eligible members of the Founding 100 receive a personal 20% discount on all Emotag animal products for three years from the date the first Emotag commercial product becomes available.

The discount is non-transferable, has no cash value and cannot be combined with other discounts unless stated otherwise. It applies to the product price only, and not to delivery charges, taxes, gift cards, subscriptions or third-party products, none of which are Emotag animal products. We may use a unique code or verified email address to administer the benefit.

If your Founding Tester order is cancelled, refunded in full or determined to be fraudulent, the benefit ends.

13. Intellectual property

The Emotag name, website content, product concepts, designs, instructions and related materials are owned by us or used under licence. Purchasing a kit does not transfer any intellectual-property rights.

You may not reproduce, reverse engineer, commercially exploit or distribute the kit or its documentation except to the extent such restriction is prohibited by law.

14. Personal data

We process personal data in accordance with our Privacy Policy. Stripe processes payment information under its own privacy terms. Information about cookies and similar technologies appears in our Cookie Policy.

15. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or any mandatory consumer right.

To the extent permitted by law, we are not responsible for indirect or unforeseeable loss, or for loss caused by using the kit contrary to the supplied instructions or outside its stated purpose.

16. Changes to these Terms

The version accepted at the time of your order governs that purchase. We may update these Terms for future orders. If a change materially affects an existing order, we will notify you and, where required, obtain your agreement or offer cancellation and a refund.

17. Governing law and disputes

These Terms are governed by Swedish law. If you live in another EU or EEA country, this choice does not deprive you of mandatory consumer protection provided by the law of your country of residence.

Please contact us first at hello.emotag@outlook.com so we can try to resolve the issue. Consumers may also contact their local consumer-advice service. Swedish consumers may refer eligible disputes to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) at arn.se. We will participate where required by applicable rules.
